If the offender violates the court order on temporary protection, the victim should report the violation to the police immediately by calling the State Police Emergency Line on 110.

Commencement of proceedings

The police control whether the perpetrator complies with the court order and the preventive measures set therein. Therefore, the police are obliged to start criminal proceedings if they receive information that the perpetrator has violated the order on protection, regardless of whether the victim has filed an application to the police or not. However, in practice, such information is most commonly provided by the victim herself or himself.

Appeal

If the victim of domestic violence submits an application to the police regarding the violation of the court order on protection, yet the police decide not to initiate criminal proceedings, the decision of the police may be appealed to the relevant office of the district prosecutor within 10 working days after receiving the notification of the decision.
